Form I-130 is related to showing proof of a relationship with a U.S. citizen. On the other hand, Form I-140 is an employment-based petition. Both of these are related to Form I-485. 

However, this is basically a kind of immigration form which is related to a change of status. It’s about giving you a green card to live in the United States permanently. Form I-485 is commonly known as Adjust Status or Application to Register Permanent Residence.

Eligibility Criteria

To get a green card, you will need to maintain or surpass a few important criteria. USCIS is very strict about its rules, and when you are trying to get a permanent staying-solution to the place, you will need to meet some key eligibility criteria. 

When you are going to get a green card via marriage, the foreign spouse must meet such criteria. 

  • Must have a valid visa (checked and approved) and its immediate availability. 
  • Form I-130 must be available with you or should be applied at the same time as Form I-485.

Exclusion Criteria

Apart from the eligibility criteria, there are various exclusion instances available to let you not get the green card at all. We know that the rules are strict, and thus there are many situations available for this particular Form to let you refrain from the green card. 

  • If the spouse is not present in the U.S.
  • If you are a crewman in the U.S.
  • If you have entered the U.S to travel elsewhere. 
  • If you are there related to some law case. 

Apart from the common instances, there are some special cases that might not let you get a green card there. 

  • If you have a serious mental condition. 
  • If you have serious criminal convictions.
  • If you have an immigration violation history. 

Gather Important Supporting Documents To Get The Approval

There are some important documents that you will need to keep with you and make sure that you present those when asked for. 

  • Birth certificate and passport.
  • Form I-94 travel history with a valid visa for the U.S.
  • Medical checkup form of USCIS doctor.
  • Financial tax return documents. 

Make sure that you have kept all these documents with you and managed to provide them wherever necessary. If you have any kind of criminal record, you will need to show them immediately; otherwise, your previous visa also can be canceled for breaching.
